Harassment and Hostile Work Environment

A hostile work environment claim arises when an employee suffers from workplace harassment because of the employee’s protected characteristic (i.e. gender, age, race, disability, etc.), thereby rendering the employee’s working conditions abusive and intolerable.

  1. the complained of conduct would not have occurred but for the employee’s protected characteristic and
