Frank A. Custode
Frank A. Custode has extensive experience representing clients in a wide variety of employment law matters, including matters involving employment discrimination, wrongful discharge, harassment and hostile work environment, whistleblower retaliation, wage and hour violations, federal and state family and medical leaves, and disability accommodations.
In addition, Frank has substantial experience both negotiating and counseling employees on issues related to employment agreements, restrictive covenant agreements (including non-compete, non-solicitation, and confidentiality agreements), independent contractor agreements, and severance agreements.
Prior to starting his own law practice, Frank primarily represented management in employment law matters at a national employment and labor law firm as well as a New Jersey-based law firm. During that time, in addition to handling a wide array of employment law litigation, Frank counseled management on employment law issues such as the discipline and discharge of employees, reductions in force, severance, workplace investigations, and the development and revisions of employee policies and handbooks.
In representing employees, Frank utilizes his prior significant experience and insight as a management-side employment lawyer to provide strategic legal counseling to his clients.
Frank is a New Jersey Court Rule 1:40 qualified mediator. With significant experience representing both management and employees, Frank has a strong understanding of the issues that are important to both sides in an employment law dispute, which helps him facilitate settlement dialogue as a mediator.
Frank is the author of several employment law publications and has been a presenter on a variety of employment law topics. Frank has been named on the New Jersey Super Lawyers list for 2017, which is issued by Thomson Reuters. He has also been named on the New Jersey Super Lawyers “Rising Stars” list from 2013-2015, which is is also issued by Thomson Reuters. Frank is admitted to practice in the State of New Jersey, the State of New York, the United States District Court for the District of New Jersey, the United States District Courts for the Southern and Eastern Districts of New York, and the United States Court of Appeals for the Third Circuit.
Frank graduated magna cum laude from Drew University in 1997, receiving a Bachelor of Arts in Political Science. He then graduated magna cum laude from New York Law School in 2000. While attending New York Law School, Frank served as an Articles Editor for the New York Law School Law Review. Following his graduation from New York Law School, Frank served as a judicial law clerk for the Honorable Joseph A. Falcone, A.J.S.C., Superior Court of New Jersey, Essex County.
From 2014-2017, Frank served as a Board Member for Straight & Narrow, Inc., which is a Catholic Charities Agency in the Diocese of Paterson. Frank is a member of the New Jersey chapter of the National Employment Lawyers Association (“NELA-NJ”).
